Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you ("subscriber" or "you") and KGN Netsol Pvt. Ltd. ("KGN Netsol", "we", "us", or "our"), a company registered in Gujarat, India, with its registered office at Shop No 209, Taj Plaza, Sanjan Zanda Chawk, Sanjan, Gujarat — 396150.

By subscribing to or using any of our services — fiber broadband, IP camera setup, or IPTV — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Our Services

KGN Netsol provides the following services in and around Sanjan, Gujarat:

  • Internet / Broadband — fiber-optic last-mile broadband connectivity
  • IP Camera Setup — supply, installation, and maintenance of IP-based CCTV systems
  • IPTV — internet-protocol television services over our network

Service availability, speeds, and features are subject to technical feasibility at your location and the plan selected.

3. Subscriber Obligations

You agree to:

  • Provide accurate and complete personal and installation details
  • Pay all applicable charges on time as per your selected plan
  • Use the services only for lawful purposes in compliance with all applicable Indian laws, including but not limited to the Information Technology Act 2000, the Indian Penal Code, and TRAI regulations
  • Not resell, share beyond your household/premises, or commercially redistribute our services without prior written consent
  • Not tamper with, modify, or attempt to bypass any network equipment provided by us
  • Not use the services to transmit unsolicited bulk messages (spam), engage in phishing, distribute malware, or conduct any form of network attack
  • Promptly notify us of any unauthorised use of your connection

4. Plans, Billing & Payment

  • Service plans, pricing, and validity are as published on our Plans page and may be updated from time to time
  • Payment is due in advance for the selected validity period. Services may be suspended without notice if payment is not received by the due date
  • We do not offer refunds for partial unused periods unless a service fault is attributable solely to KGN Netsol
  • Installation charges, if applicable, are payable once and are non-refundable
  • Any applicable government taxes (GST, etc.) are in addition to quoted prices unless stated otherwise

5. Fair Use & Network Management

To maintain a quality experience for all subscribers, we may implement reasonable network management practices including traffic shaping during periods of congestion. Unlimited plans are subject to our fair-use policy; sustained high-volume usage that degrades the experience of other subscribers may result in temporary speed management.

6. Service Availability & Interruptions

We aim for continuous service but do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance where practicable. We are not liable for service interruptions caused by:

  • Force majeure events (floods, storms, natural disasters, power outages, civil unrest)
  • Damage to infrastructure by third parties
  • Government directives or regulatory orders
  • Faults in equipment owned by you or upstream providers

7. Equipment

Where KGN Netsol provides equipment (routers, ONTs, cameras, set-top boxes), such equipment remains the property of KGN Netsol unless explicitly transferred by a written sale agreement. You are responsible for the safekeeping and proper use of such equipment. Loss or damage due to negligence may be charged to you at replacement cost.

8. Suspension & Termination

We may suspend or terminate your service immediately and without prior notice if you:

  • Fail to make payment within the due period
  • Breach any of these Terms in a material way
  • Use the service for illegal purposes
  • Provide false information during registration

You may terminate your subscription at any time by notifying us in writing. Termination does not entitle you to a refund of any pre-paid amounts.

9. Limitation of Liability

To the maximum extent permitted by Indian law, KGN Netsol's total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you in the three months preceding the claim.

We are not liable for indirect, incidental, or consequential losses, including loss of business, data, or revenue, arising from use or inability to use our services.

10. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall first be attempted to be resolved amicably. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Valsad, Gujarat, India.

11. Changes to These Terms

We may revise these Terms at any time. The current version will always be available on this page with the effective date shown at the top. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
